Acceptance of Terms
By creating an account on Check Up ("the Platform"), you agree to these Terms of Service ("Terms"). If you do not agree, do not create an account or participate in any events.
Eligibility
- You must be at least 18 years of age.
- You must reside in a jurisdiction where skill-based competition entry fees are permitted. Registration is currently blocked in: Arkansas, Connecticut, Delaware, Louisiana, Montana, South Carolina, South Dakota, and Tennessee.
- You must have a valid Xbox Live or PlayStation Network account linked to your Check Up profile.
- One account per person. Multiple accounts result in permanent ban.
Account Verification
- All accounts must be verified via Discord OAuth with public Xbox or PlayStation connections, OR via manual bio verification through the platform.
- Unverified accounts cannot participate in ranked matches, receive prize payouts, or access premium features.
- Verification may be revoked if your linked console account is disconnected, suspended, or found to be fraudulent.
Entry Fees and Prize Pools
- Entry fees for tournaments and seasons are non-refundable except through the Full Attendance Refund Pool (complete all scheduled games in a season to qualify).
- 100% of player and coach entry fees are allocated to the prize pool. The platform operator (Service Plug Events LLC) receives zero percent of entry fees.
- Prize pool distributions are pre-announced before registration opens. Distributions are skill-determined and based on competitive outcomes.
- This is a skill-based competition, not a game of chance. Entry fees are payments for participation in a skill-based contest.
Gamertag Policy
- Your gamertag is your identity on the platform. Stats, rankings, and reputation are tied to it.
- If you change your gamertag on Xbox Live or PlayStation Network, the platform will detect the change within 24 hours and lock your account until resolved.
- Resolution: use your monthly tier allowance (Pro: 1/mo, Elite: 3/mo, Commissioner: unlimited) or pay the $2.99 name change fee.
- Failure to resolve within 7 days results in removal from active rosters and forfeiture of season entry fee.
Code of Conduct
- Slurs, threats, doxxing, and targeted harassment are prohibited in all platform channels (Discord, in-app chat, team messages, voice channels).
- Progressive enforcement: 1st offense = 24-hour mute, 2nd = 7-day suspension, 3rd = permanent ban.
- Stat manipulation, screenshot fraud, or submitting another player's game session = permanent ban + season stats voided.
- Intentional disconnects ("rage quits") are treated as forfeits.
Automated Enforcement
- All rules are enforced by the platform's automated rules engine ("the Bot").
- No human, including the founders, has the authority to override routine enforcement decisions.
- Appeals may be submitted within 48 hours of any enforcement action. Appeals are reviewed by a secondary automated process, not a person.
- The appeal decision is final.
Tax Obligations
- Prize winnings of $600 or more in a calendar year will be reported to the IRS on Form 1099-MISC, Box 3 (Other income).
- Winners must submit a valid W-9 (US persons) or W-8BEN (non-US persons) before any prize disbursement. No form = no payout.
- Service Plug Events LLC is the payer of record for 1099 reporting purposes. (ModernGrindTech powers the platform but is not the operator.)
- You are solely responsible for reporting and paying any taxes owed on your winnings.
Intellectual Property
- By participating in Check Up events, you grant the platform a non-exclusive, royalty-free license to use your gamertag, gameplay clips, screenshots, and likeness for promotional purposes including but not limited to: social media posts, highlight reels, streaming broadcasts, and marketing materials.
- You retain ownership of your original content. This license is limited to Check Up promotional use.
Dispute Resolution
- All disputes between participants and the platform shall be resolved through binding arbitration administered under the rules of the American Arbitration Association.
- Class action waiver: you agree to resolve disputes individually, not as part of a class action.
- Governing law: State of Florida. Arbitration seated in Palm Beach County, Florida.
Limitation of Liability
- The platform is provided "as is." Check Up, Service Plug Events LLC, and ModernGrindTech are not liable for: server downtime, data loss, incorrect stat calculations, delayed payouts, or any action taken by the automated enforcement system.
- Maximum liability is limited to the amount of entry fees paid by the user in the current season.
Modifications
- These Terms may be modified between seasons with 14 days notice posted in the Discord #announcements channel and on the platform.
- In-season modifications require unanimous consent of the founding team.
- Continued use of the platform after modifications constitutes acceptance.
Termination
- Either party may terminate the account at any time.
- Upon termination: active season entry fees are forfeited, pending prize payouts are canceled, and account data is retained for 90 days before deletion.
- Banned accounts cannot be reinstated without a successful appeal.
Common Questions
Will I receive a tax form for prize winnings?
Yes if you win 600 dollars or more in a calendar year. Service Plug Events LLC is the payer of record and will issue Form 1099-MISC Box 3 for US persons or W-8BEN reporting for non-US persons. You must submit a valid W-9 or W-8BEN before any payout is sent.
Can I play from any US state?

How are disputes between me and Check Up resolved?
Through binding arbitration administered under the rules of the American Arbitration Association. You agree to resolve disputes individually (no class actions). Governing law is the State of Florida, with arbitration seated in Palm Beach County, Florida.
What happens to my account data if I delete or get banned?
Account data is retained for 90 days after termination, then deleted. Active season entry fees are forfeited and pending prize payouts are canceled at termination. Banned accounts cannot be reinstated without a successful appeal.
How will I know if the Terms change?
Modifications happen between seasons with at least 14 days notice posted in the Discord announcements channel and on the platform. In-season changes require unanimous consent of the founding team. Continued use after a change counts as acceptance.
